Agreement to Terms
By accessing or using El Chamancito Soundscapes ("Chamancito," "we," "our," or the "Service"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree with any of these terms, you may not use or access the Service. The Service provides generative, browser-based shamanic audio—"Software for the Soul"—including ritual soundscapes, parameter controls, saved recipes (Medicine Bag), optional biofeedback integration, and related features.
Not Medical or Professional Advice
El Chamancito is intended for ceremonial, contemplative, and personal growth use. It is not a substitute for professional medical, psychological, or psychiatric care. Do not use the Service to diagnose, treat, or manage any health condition. If you have health concerns, consult a qualified professional. Use of binaural or isochronic tones, biofeedback features, or intense ritual practices may not be suitable for everyone; use at your own discretion and discontinue if you experience discomfort.
Use License
We grant you a limited, non-exclusive, revocable license to use the Service for personal or (where your subscription permits) professional ceremonial use. This license does not include:
- Copying, modifying, or reverse-engineering the Service or its software
- Reselling, sublicensing, or redistributing the Service or any exported audio in a way that competes with us, without separate agreement
- Removing copyright, trademark, or other proprietary notices
- Using the Service in any way that violates these Terms or applicable law
You may export audio for use in your own ceremonies, sessions, or personal practice in accordance with your subscription and our export guidelines. Commercial use of exported audio may be subject to your plan (e.g. healer_license) or additional terms.
User Accounts
To use features such as the Medicine Bag, saved recipes, and biofeedback, you must create an account. You are responsible for:
- Maintaining the confidentiality of your credentials
- All activities under your account
- Providing accurate and complete information
- Notifying us promptly of any unauthorized use
Your Content and Data
You retain ownership of the soundscape recipes and other content you create and save. By using the Service, you grant us a license to store, process, and display that content as needed to operate the Service (e.g. saving and loading recipes, or showing public recipes if you make them public). We do not claim ownership of your recipes. Our use of biofeedback and usage data is described in our Privacy Policy.
Subscription and Payment
Some features may require a paid subscription (e.g. healer license, extended export, or premium layers). Fees, billing cycles, and refunds will be presented at the point of purchase or in separate subscription terms. We may change fees or plans with reasonable notice; continued use after a change may constitute acceptance. You are responsible for any applicable taxes.
Prohibited Activities
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable law
- Post or transmit false, misleading, or fraudulent content
- Interfere with or disrupt the Service, its infrastructure, or other users’ use
- Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
- Harass, abuse, or harm others, or use the Service in a way that disrespects the ceremonial or sacred nature of the tools we provide
- Scrape, automate, or bulk-download content in a way that harms the Service or others
Service Availability and Changes
The Service is provided "as is" and "as available." We strive for reliability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features or the whole Service, with reasonable notice when practicable. We are not liable for any loss or inconvenience due to downtime, data loss (beyond our obligations under the Privacy Policy), or changes.
Limitation of Liability
To the fullest extent permitted by law, El Chamancito Soundscapes and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising from your use or inability to use the Service, or from any reliance on the Service for health, spiritual, or other outcomes. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve months before the claim (or one hundred US dollars if you paid nothing). Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted.
Indemnification
You agree to indemnify and hold harmless El Chamancito Soundscapes and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.
Changes to Terms
We may update these Terms at any time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated by email or through the Service. Your continued use after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service and may close your account.
Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of that jurisdiction, except where prohibited. You may also have rights under consumer protection laws in your country.
Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision does not waive that right or provision.
